Ontario regulator seeks consultants to negotiate hydro contracts

Ontario Power Authority seeks proposals offering technical and financial consulting services to negotiate new contracts with hydroelectric project operators. Bids are due June 1.

The request for proposals follows a directive by Ontario’s Minister of Energy and Infrastructure that Ontario Power Authority pursue new contracts for hydropower facilities. Negotiations for the new contracts will be carried out with owners or operators of the hydropower projects or parties that own or control the facilities’ electrical output.

The consultant is to prepare a strategic framework for contract development and develop a work plan in consultation with power authority staff and legal counsel. The consultant also is to: participate in contract negotiations with facility parties; provide technical and financial consulting services to support contract negotiations; and help prepare financial models to support contract pricing and other contractual parameters.

The successful bidder also is to: perform due diligence review of information provided by counterparties and issues that arise during the course of contract negotiations; assist in negotiating terms and conditions; review draft and final contracts with external counsel, power authority staff, and facility parties to support execution of new contracts.

OPA issued a separate request for proposals to provide external legal counsel for developing and negotiating new contracts with hydroelectric facilities. Bids for that work also are due June 1.
